“You” and “Your” means each visitor to our website and each person who orders a use authorisation from us.

All content and materials available on this site and in our model reports is owned by us and is protected by copyrights, trade marks and/or other proprietary rights and laws. Except as expressly authorised by us, you agree not to sell, license, rent, modify, distribute, copy, reproduce directly or indirectly, transmit, publicly display, publish, adapt, edit or create derivative works from such material or content at any time. You may receive and display the content of the website on a computer screen, print individual pages on paper (but not photocopy them) and store such pages in electronic form on disk (but not on any server or other storage device connected to a network) for your personal, non commercial use or for the purpose of ordering use authorisations.

Orders of Model Report Use Authorisations

Each purchase of a use authorisation licenses you for use once only of that Model Report in relation to the vehicle which has the chassis number which you provide to us when you purchase the use authorisation. You may not resell or assign any use authorisation which you acquire from us.

After you order a Model Report use authorisation, we will send you a written note of your order. Please check that this is correct and then sign and return the confirmation to us. When we receive the signed confirmation we will send the Model Report use authorisation to you by first class post within two working days.

Your order will not constitute an agreement on our part to provide a use authorisation to you until your order is accepted by us sending to you the order confirmation.


Warranty

We take reasonable care in compiling our Model Reports. However, we have no control over the use of the Model Report by you or by the person conducting the ESVA test on your vehicle; we therefore do not warrant that your vehicle will pass the ESVA, or any other test as a result of your Model Reports use authorisation.

Our Liability to You

If the Model Report service is suspended or terminated for any reason, you will not be entitled to a refund of any payment which you have already made to us, and we will not be liable to you for any loss or damage suffered by you as a result.

[In the event that we issue or recommend an incorrect model report and do not within seven working days of being notified of the error provide the correct model report to the test station at which your vehicle is to be tested, we will refund to you the sums which you have paid to us in respect of that order.]

[In the case of a person who is not dealing as a consumer, if the Model Reports service is suspended or terminated for any reason, our liability to you is limited to the amount of any payment which you have already paid to us.]

In the case of a person who deals as a consumer, our liability will not be limited in respect of negligence or breach of contract on our part which causes death or personal injury.

Volume Users

A single user which acquires 100 use authorisations in any one calendar month is entitled to a further 25 use authorisations free of charge. The free use authorisations must be used within the following three months and their use does not count towards the number of use authorisations acquired by that user for the purpose of further volume user benefits.

[You can obviously insert different figures if you decide to offer this benefit at a different rate of 25 free for each 100 bought. The terms of the volume user scheme, like the other Terms and Conditions set out here, can be varied under the Variation clause below.]

Your Right of Cancellation

You have the right to cancel the Contract at any time during the period of seven working days, beginning with the day after the day on which your Contract with us is concluded. You will not have the right to cancel the Contract once performance of the Contract has begun.

Miscellaneous

These Terms and Conditions and any agreement entered into between you and us shall be governed by and construed in accordance with English Law. You irrevocably agree that the Courts of England shall have exclusive jurisdiction over any dispute which may arise out of, under or in connection with these terms or any agreement between you and us.

You may not assign, sub-licence or otherwise transfer any of your rights under these terms and conditions.

Failure by the company to exercise any right or remedy shall not amount to a waiver or that or any other right or remedy.

Headings in these terms are for convenience only and will have no legal meaning or effect.

Unless otherwise specified, these Terms and Conditions and the information about our service contained on the website constitute the entire agreement between you and us and supersede all prior agreements, arrangements and understandings between you and us. Any addition to or modification of these Terms will not be valid unless agreed in writing between you and us.

If any provision or term of these terms and conditions shall become or be declared illegal, unlawful, invalid or unenforceable for any reason whatsoever, such term or provision shall be divisible from the other Terms and Conditions and shall be deemed to be deleted from them.

Alterations

We may alter these Terms and Conditions from time to time and post the new version on our website, following which all use of our website will be governed by that version. You must check the Terms and Conditions on the website regularly.

We cannot and do not guarantee or warrant that any material available for downloading from our website will be free from infection, viruses and/or other code that has contaminating or destructive properties.
